Disclaimer

FishHogs is provided “as-is” as a recreational reference tool for anglers fishing US coastal waters and the Great Lakes. Chart data is sourced from NOAA and is provided for general reference only.

This app is not a substitute for official NOAA nautical charts, US Coast Guard Light Lists, Notice to Mariners publications, or any other official navigation aids. It must not be used as the sole means of navigation.

Electronic charts and GPS positions are subject to error, delay, or failure at any time. Always carry and consult official paper charts and maintain a proper lookout when underway.

Terms of Use

By using FishHogs, you acknowledge that:

• No guarantee is made regarding the accuracy, completeness, or timeliness of any chart data, depth information, or positional data displayed in this app.
• The app may be unavailable or experience interruptions at any time without notice.
• You are solely responsible for the safe operation of your vessel and for all navigation decisions.
• You assume all risk associated with the use of this app, including but not limited to risks arising from inaccurate data, equipment failure, or loss of GPS signal.

Indemnification

You agree to hold the developer and all contributors to FishHogs harmless from any and all losses, damages, injuries, claims, or liabilities arising from your use of this app, including but not limited to property damage, personal injury, grounding, collision, or any other incident that may occur while relying on information provided by the app.

For the avoidance of doubt, this includes — but is certainly not limited to — any bruised egos, tall-tale deficiencies, or emotional distress resulting from your failure to catch any fish whatsoever. FishHogs puts the charts in your hands; what you do with them is between you and the fish. We make no warranty, express or implied, that using this app will make you a better angler.

Warranty Disclaimer & Limitation of Liability

No warranty. FishHogs is provided “AS IS” and “as available”, without warranty of any kind. To the fullest extent permitted by law, we disclaim all warranties, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement, and any warranty arising from course of dealing or usage of trade.

In particular, we make no warranty that FishHogs is fit for marine navigation. It is a recreational reference tool. Chart data, depth and bathymetry data, tide and current predictions, weather, positions, headings, and any line drawn between two points may be incomplete, out of date, or wrong, and may become unavailable without notice. FishHogs is not certified or approved as a navigation system, is not ECDIS or an approved electronic chart display, and does not satisfy any chart carriage requirement. Do not rely on it to avoid hazards, to judge safe water, depth, or clearance, or as a sole or primary means of navigation.

Limitation of liability. To the fullest extent permitted by law, neither the developer nor any contributor to FishHogs is liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, nor for any loss of profits, revenue, data, use, or goodwill, nor for any property damage, personal injury, death, grounding, collision, allision, stranding, capsizing, sinking, salvage or towing cost, environmental damage, or loss of or damage to any vessel, arising out of or relating to your use of — or inability to use — FishHogs, whether the claim is based in contract, tort (including negligence), strict liability, or any other theory, and even if we have been advised of the possibility of such damages.

To the fullest extent permitted by law, our total aggregate liability for all claims relating to FishHogs is limited to the greater of (a) the amount you paid us for FishHogs in the twelve months before the event giving rise to the claim, or (b) US $50.

These limits apply even if a limited remedy is found to have failed of its essential purpose, and they are a fundamental part of the basis of our agreement: without them, FishHogs would not be offered at this price.

Some jurisdictions do not allow the exclusion of certain warranties or the limitation of liability for certain damages — including, in some places, liability for death or personal injury caused by negligence, or for fraud. Where that is the case, the exclusions and limits above apply only to the extent permitted, and nothing here limits any right you have that cannot lawfully be limited. Nothing in these terms affects your statutory consumer rights.

And yes — the fish-related disclaimers above still stand. Both things are true at once: we are not liable if you put your boat on a rock, and we are also not liable if you get skunked.

Changes to These Terms

We may update these Terms of Use from time to time. When we do, we will revise the effective date at the top of this page. Continued use of the app after a change constitutes acceptance of the updated terms.
